Sharkspeed purchasing conditions

Open purchase
We offer open purchase for 30 days from the date you received your order. In order for a product to be returned via Open Purchase, the product must be returned in new condition and, if there is original packaging, it must be included when returning and be in the same condition as when purchased. The customer must be able to present a valid proof of purchase in the form of a receipt or copy of the receipt. 
To return a product, you can visit the store. If the product was purchased via e-commerce, you can also send the product to us for return.
Custom-made or special orders where the product is manufactured/modified specifically for a customer do not apply to open purchases.
NOTE! Normally it takes about 2 weeks from the time you send your return to us before you receive any refund. In exceptional cases, it can take up to 30 days for a refund, which is the maximum time according to law. We do not do exchanges.

Warranty
We generally provide a one-year warranty on all products from the original date of purchase. To claim under the warranty, the relevant proof of purchase, receipt, delivery note, etc. must accompany the complaint. The warranty does not cover the costs of repairs at someone else's, unless otherwise agreed in advance with our customer service. Please note that special warranty terms may apply to products from other suppliers and manufacturers.
The warranty covers defects caused by material or manufacturing defects. Such a defect that becomes apparent within the warranty period shall be deemed to have existed at the time of purchase. Wear and tear, improper use are not covered by the warranty. Without prejudice to your statutory rights, Sharkspeed reserves the right to repair or replace the product in the event of a complaint during the warranty period.
 
Complaint
You as a customer have the right to complain about an original defect – a defect that was already present at the time of purchase – in your product as long as you complain about the product within 1 year of receiving the product. If you wish to claim a defect in the product, you should contact Sharkspeed as soon as possible after the defect was discovered. For the complaint to be valid, it must be made within a reasonable time after you noticed or should have noticed the defect. A complaint made within two months of the defect being discovered is always considered to have been made within a reasonable time, more doubtful thereafter. To complain, please contact our Customer Service. 
Outside the voluntary warranty period, it is you as the customer who is obliged to demonstrate that any defects existed at the time of purchase. We are happy to help you with an investigation with our suppliers. If we do not approve the complaint, however, an investigation fee will be charged. If you then choose not to return the product or if you choose to repair the product with us at your own expense, no investigation fee will be charged.
Incorrect delivery or damage in transit must also be reported within a “reasonable time” from the time the defect was discovered. We recommend that you examine the products when you receive them and that you report any damage to the packaging directly to the freight forwarder or delivery point and note these on the shipping documents. 
We do not accept Bus Goods. Send the package as a company package for the fastest handling. In the event of a complaint/return/exchange, there is the option to purchase discounted shipping labels directly from our website. We will then send you a shipping label via email, which you then print out and attach to the package and hand it in at your nearest delivery point (Posten). When purchasing shipping labels from our website, the handling time is reduced, given that the package is sent as a company package and delivered to us the next day. If you choose to send the package as a regular postal package instead, the handling time will be longer, given that the package must then be personally collected from the nearest service point.

Please note that a copy of the receipt must be included with the package and a description of the complaint. If the package is damaged upon delivery, you must immediately file a complaint when you pick up your package. So be sure to check the package when you pick it up.

Refund
When returning an item, you will receive a refund of the amount paid for the product immediately after the case is closed. Please note that this may take up to 8 working days. In the first instance, the refund will always be made using the same payment method used at the time of purchase. 

Delivery 
Products that are in stock are normally shipped from our warehouse 1-5 business days after the order is placed. During high sales, delays may occur. We try our best to always deliver as quickly as possible. We of course try to ship your order as quickly as possible, but possible delays may occur depending on the season and time of the order. Our goal is that all orders received on a weekday before 10:00, which also only consist of products that are in stock, will be shipped the same day. When the products have been packed and are ready to be shipped to you, a delivery confirmation containing the package number and other information about your order will be sent by email to the address provided in your account. The delivery confirmation is sent when the package has been packed and not when the transport has begun. It may therefore take a few more hours/day before the package can be tracked via, for example, the Post Office website. If your order contains both products that are out of stock and products that are in stock, there is the possibility of having the products that are in stock sent to you earlier than those that are currently out of stock. If this should happen, you will be contacted first by us.

Unclaimed shipments 
We reserve the right to charge you the costs of return shipping, handling costs, etc. You will be charged a mini-fee of SEK 250 for unclaimed packages.

Fair Use – policy:

Our assessment of whether you are violating our Fair Use Policy is based on a number of non-discriminatory criteria. These criteria take into account systematically deviating behavior. An order that is at risk of being rejected due to our Fair Use Policy can be identified by our staff or by an algorithm that reads abnormal patterns in our customers' purchasing and return behavior. The final assessment of whether the order should be accepted or rejected is always made by our staff. If your order is rejected, you will be informed of this via an email sent to the email address you provided when placing the order, or an order can be canceled completely. Once we have notified you that we have refused you to shop with us, the decision applies to you regardless of your profile or email address. It is not permitted to try to circumvent this decision in any way. e.g. by shopping in someone else's name. Repeated attempts to order can be reported to the authorities that handle this.

Please note that our Fair Use Policy never prevents you from exercising your statutory right of withdrawal of 14 days or Sharkspeed Online Solutions' open purchase which is valid for between 14-30 days (Non-tailored products/Special orders) if you have made a binding purchase with us. However, our Fair Use Policy may in specific cases prevent you from entering into a contract with us.

Examples of behavior that violates our Fair Use policy:

- frequent or recurring abnormal purchasing and return behaviors that show that the customer previously had no intention of keeping ordered products.

- Fraud attempts in connection with returns, such as changing/forging labels and price tags and false claims of lost products.

We strive to make the fairest and most accurate assessment possible if we have reasonable grounds to suspect that you are violating our Fair Use Policy. You always have the right to request that we reconsider our assessment by contacting us at helpdesk@sharkspeed.com or by phone at 010-5519786

Printing errors etc. 
We reserve the right to make corrections for printing errors, errors in information and errors in product specifications. All images are for illustrative purposes only and do not necessarily reflect the exact appearance and condition of the product.

All content on these pages is to be considered the property of Sharkspeed or its subcontractors. The information is protected by, among other things, copyright, marketing and trademarks. This means that trademarks, company names, product names and information about products regarding, among other things, the weight of the product, images and graphics, design, layout and other content may not be copied or used without explicit permission (in writing) from Sharkspeed.

Custom orders 
Sharkspeed is proud to offer custom-made orders at low prices. When ordering custom-made items, it is very important that you check your measurements very carefully and follow our recommendations and step-by-step help when taking measurements. The right of withdrawal and the right of exchange do not apply to custom-made orders. In the case of incorrectly sewn products, the measurements you have specified will be checked with the measurements on the product. Please note that the factory adds 3-10 cm to the measurements depending on the location to ensure optimal mobility of the product. After receiving your order, your size will be checked. Please note that the price of this product applies to body sizes up to 3XL. For larger body sizes, an additional cost of 100 SEK/textile, 150 SEK/leather per size exceeded will be added. The additional cost is calculated by a Sharkspeed administrator after receiving your body measurements. The delivery time is between 12 - 30 working days depending on seasonal load. Custom-made solutions cannot be ordered as cash on delivery.
When measuring in a store with an employee, a fee of 495:- SEK is charged.

All additional fees are charged afterwards and before production begins.

Independent advice and dispute resolution
In addition to contacting our customer service for help with complaints, right of withdrawal or other questions regarding your order, you as a consumer can contact your municipality's consumer guidance or the Swedish Consumer Agency's information service Hallå Konsument for advice and information. You as a consumer also have the right to contact the Swedish General Complaints Board (ARN). ARN can be reached either via www.arn.se or via the address Box 174, 101 23 Stockholm. In the event of a dispute, we follow ARN's recommendations. As a consumer, you can also complain via the EU's online platform for dispute resolution, which you can reach via https://ec.europa.eu/consumers/odr.
About cookies 

This website contains so-called cookies. A cookie is a small text file that is stored on your computer and contains information. There are two types of cookies. One type saves a file permanently on your computer. The other type of cookie is called session cookies. While you are browsing a page, this cookie is sent between your computer and the server to be able to link information, such as which login name you use. Session cookies are not stored permanently on your computer, but disappear when you close your browser. Security and SSL 
We use a security standard called 3D-Secure. It is a security standard developed by VISA and Mastercard to ensure secure payments over the Internet. All information is encrypted with 128-bit SSL encryption, which means that no unauthorized person can access your card details. We also use SSL (Secure Socket Layer), which is a protocol for secure transmission of data via the Internet (or other networks). The company Netscape Communications has developed and developed the SSL protocol, which has now become an industry standard. A protocol is a set of rules and procedures for how information (data) is to be processed. The SSL protocol processes the data in several different ways and "reverses" the information. This is done so that the data is not readable during transmission between the two computers; this "reversal" is called encryption. When the data is received by the recipient, SSL ensures that the data is "restored" to its original order, checks that the sender is correct (Server Authentication) and also checks that the data has not been changed during transmission (Message Integrity). SSL uses digital certificates to verify the sender, recipient or both sender and recipient of the data transmission. A digital certificate is the "tool" used to link information about an individual or organization to a so-called "public key" with two purposes: All SSL certificates for the internet are handled by companies that are certified certificate creators. This also means that all SSL certificates are unique and correctly issued. Everyone who applies for an SSL certificate must prove their own or their organization's identity in order to purchase an SSL certificate.

FORCE MAJEURE 
In the event of war, war-like event, civil war, revolution, rebellion, government action, strike, lockout, blockade, natural disaster or similar event, Sharkspeed will be able to apply force majeure. This means that this agreement does not have to be fulfilled in full. If this occurs, we will try to notify the customer of this. In the event of a dispute, we will of course follow the decision of the Swedish National Board of Complaints.

OWNERSHIP 
All goods remain the property of Sharkspeed until full payment has been received. Sharkspeed reserves the right to cancel a purchase if fraud is suspected.

Change in terms of sale 
Sharkspeed reserves the right to change the current terms of sale.

Klarna Checkout offers you a customized and secure payment experience every time you shop. Klarna Checkout identifies you using the information you provide when you shop and, if necessary, with information from suppliers. Klarna Checkout guarantees your goods. You never have to pay if you have not received your goods. Through Klarna Checkout, you are offered different options for paying for purchases made at affiliated stores. Klarna Checkout presents certain information to you as soon as you are identified. The information you need to provide to achieve identification may vary between different purchase occasions and customers. No credit information is ever taken directly in Klarna Checkout, but only when necessary by the payment option you have chosen. Credit information taken by Klarna does not affect your credit rating and cannot be seen by others who request credit information about you, such as banks. Invoice is the default payment option, but you are of course free to choose any of the other options, such as direct payment via bank or payment by card. Klarna's terms of use

By using the Klarna Checkout checkout service, you agree to Klarna AB's (556737-0431, Norra stationsgatan 61, 113 43 Stockholm) terms and conditions as set out below, including any appendices or other materials referred to ("Terms"). By providing or requesting information, you begin using Klarna Checkout. You have thereby also agreed to our processing of your personal data, including the possibility for us to transfer the data to third parties or for processing outside the EU/EEA area.

Guarantees

You guarantee that the information you provide is correct and yours, or that you have the right to represent the specified person, and that you may enter into agreements without hindrance and without the approval of a guardian, trustee or other person. If you use Klarna on behalf of a legal person (company or other organization), you also guarantee that you are authorized to enter into this payment agreement with Klarna and the associated purchase agreement with the store. Identification, adaptation and risk assessment In order to be able to identify you securely and prevent unauthorized use or abuse of Klarna Checkout and to meet the requirements of good credit practice, Klarna needs to identify you. Klarna obtains additional information such as social security number, name, address and credit information from various suppliers. Klarna also needs to use the information that you may have provided in previous purchases. The additional information together with the information that Klarna already has enables the simple checkout and purchase process that Klarna Checkout entails. Klarna Checkout automatically adapts its security check, and thus its design, every time you use it and you do not need to enter more information than necessary. In some cases, a previously entered and Klarna-approved address is shown to you. When assessing the risk, Klarna considers a number of objective factors, but also information about how you have previously fulfilled our payment terms. By completing the purchase, you confirm your identification and correct delivery address.

Payment, fees

After identification and risk assessment, Klarna Checkout shows the payment options that can be offered to you. Whichever payment option you choose, Klarna or one of Klarna's partners is the one that handles the payment transaction, while the actual purchase of the goods or services is made directly by the store. Product or service-specific questions should therefore be directed directly to the store. Current payment options that may currently be offered through Klarna Checkout are invoice, account credit, card payment or direct payment via bank. Invoice is the default payment option. When applying a default invoice, Klarna's invoice terms and conditions in force at any time apply. There is no cost to use Klarna Checkout. However, Klarna reserves the right to charge any taxes or fees that may be incurred through the selected payment option, see the individual payment terms and conditions in more detail. There will always be information about the terms and conditions for each payment option before you make your choice. Klarna may add or remove payment options at any time.

Abuse

Use of information that is not yours or that you are otherwise not entitled to use will be assessed by Klarna as abuse. All information related to abuse or suspected abuse of Klarna Checkout, for example by providing incorrect or misleading information, is saved and used for future risk assessments and to protect the parties involved. Your compliance with the purchase and payment terms also affects the risk assessment when using Klarna Checkout and thus your ability to use all payment options.

Personal information

Klarna and its partners process your personal data in order to offer you a simplified payment via Klarna Checkout and to be able to simplify the payment process even further the next time you use Klarna's services. Klarna processes your personal data for the purpose of securing your identity, administering the customer relationship, preventing abuse or misuse of the payment service, performing customer analyses, credit assessment, risk analyses, risk management, business development, for commercial and marketing purposes for itself and for our specially selected partners, and to otherwise comply with applicable legal requirements. Personal data is any type of information that can be directly or indirectly linked to you. The following are examples of personal data that Klarna processes:
